New Family Law Forms on Stalking

In 2012, the Florida Legislature passed laws for protection against stalking. As a result, the Florida Supreme Court has drafted proposed Florida Supreme Court Approved Family Law Forms for use by parties in these cases.

Similar to petitions for domestic violence, these forms are intended to make it as easy as possible for alleged victims of an offense to have quick and easy access to the Courts, even without the benefit of assistance of counsel.

According to the Florida Bar News online, the 2012 legislation, “(1) add the term “stalking” to the titles, bodies, footers, and instructions of various forms, where appropriate; (2) add language to the instructions to form 12.980(g) regarding what information to include in a supplemental affidavit in support of a petition for injunction for protection against stalking; (3) add a blank text box to the supplemental affidavit in support of a petition for injunction for protection against stalking for the petitioner to describe the alleged stalking; and (4) renumber several forms.”

All comments must be filed with the Supreme Court on or before July 8, 2013.
