Understanding How a Parenting Plan Works

A written parenting plan sets out the rules and responsibilities of parenting a child, including, but not limited to:

  • Timesharing schedule – which parent has timesharing with the child on what dates, including holidays, summer and winter breaks
  • School district – which parent’s address will be used for school designation
  • Rules on third-party caregivers, daycare, babysitters
  • Extracurricular activities, who pays/who decides
  • Any other provisions relating to your child that are unique to your family situation and circumstances

Parents can decide on these arrangements outside of court through mutual agreement and mediation, creating a parenting plan that is then submitted to the court for approval. It will likely be approved if the plan adheres to the court’s policy of protecting the child’s best interests.

If parents cannot reach an independent agreement, the court intervenes and decides based on the child's best interests. Factors considered include the child's relationship with each parent, each parent's capacity to provide for the child's needs, the child's home stability, any history of domestic violence or substance abuse, and other considerations relevant to the case.
